Influencer Logan Paul is not going quietly into the crypto night. A Texas magistrate judge has ruled that Logan Paul’s lawsuit against YouTuber Stephen Findeisen, better known as Coffeezilla, over defamatory remarks regarding Paul’s failed CryptoZoo project should proceed. In a March 26 report in San Antonio federal court, Magistrate Judge Henry Bemporad found that Findeisen’s statements were “reasonably capable” of defamatory meaning and not mere opinion.

Logan Paul alleges that Findeisen called him “a serial scammer” and labeled CryptoZoo—a blockchain game where players supposedly buy NFT “eggs” that hatch into animals for breeding to earn tokens—a “scam” and a “massive con.” Paul insists that these malicious claims have seriously damaged his reputation. Findeisen, on the other hand, argued he meant his comments to be taken as opinion, noting that his videos on CryptoZoo were accompanied by disclaimers in their description sections. Yet, Judge Bemporad wasn’t having any of it. He wrote that the disclaimers were “not particularly prominent” and only visible when the section is expanded, meaning they did little to counteract the potentially harmful assertions.

The judge’s report clearly stated, “At the pleading stage, Plaintiff [Paul] has sufficiently alleged that the statements at issue in this case are reasonably capable of defamatory meaning and are not unactionable opinions.” He further added that context alone does not render Findeisen’s statements nondefamatory. The decision means Findeisen’s bid for an early dismissal of Paul’s lawsuit is likely to be tossed by federal Judge Orlando Garcia, who is currently overseeing the case.

This legal showdown is heating up in the wild world of crypto controversies, where CryptoZoo has long been a polarizing project. Despite Findeisen having released three videos in 2022 about the venture, and even apologizing and outlining redemption plans in 2023, Paul continues his legal pursuit. He’s not just battling public opinion; he has also filed a countersuit against business partners he blames for the CryptoZoo debacle.
